SO-Havilah Estate Refund Policy

Last updated: 2025

1. Introduction

This Refund Policy outlines the conditions under which payments made to SO-Havilah Estate (“the Company”, “we”, “us”) may be refundable or non-refundable. By making any payment to SO-Havilah Estate, you (“the Buyer”, “Client”, “Purchaser”) acknowledge that you have read, understood, and agreed to this Refund Policy.

2. Refund Eligibility

Refunds are not automatic and are granted strictly at the sole discretion of the Estate Management. Each refund request will be individually reviewed based on documentation, payment history, allocation status, and internal assessment.

3. 30-Day Refund Window

Buyers may request a refund within 30 days of their initial payment date. After this 30-day window, all payments become strictly NON-REFUNDABLE, regardless of reason.

Requests made within the 30-day window may still be denied at management discretion, in accordance with Section 2 above.

4. Administrative & Processing Deductions

If a refund is approved, the Company reserves the right to deduct:

The Buyer will receive the balance after all approved deductions have been applied.

5. Non-Refundable Payments

The following payments are automatically non-refundable:

6. Installment Plans & Refund Clarifications

Where a Buyer is on an installment plan, refund eligibility (if any) is still subject to the 30-day refund window and the discretion of estate management. For clarity, the estate offers installment options that may include:

Where applicable, any already-applied finance charges, bank fees, processing costs, or documentation expenses may be deducted from any approved refund.

7. Refund Processing Time

If a refund request is approved, processing may take between 45 – 90 working days, depending on internal verification procedures and financial processing timelines.

8. Payment Method for Approved Refunds

Refunds will be paid only to the verified bank account of the Buyer, and not to any third party. Cash refunds are not permitted under any circumstances.

9. Plot Allocation & Refund Restrictions

Once a plot has been officially allocated to the Buyer, the payment becomes non-refundable, irrespective of payment date.

Any development or survey fees communicated after allocation also become payable and are non-refundable.

10. Cancellation by the Company

If the Company cancels a project or is unable to deliver the purchased plot, buyers will be eligible for a full refund without deductions. This clause does not apply to delays, relocation offers, changes in timelines, or force-majeure events.

11. Buyer Responsibilities

Buyers are responsible for providing accurate information, including:

12. Dispute Resolution

All refund-related disputes shall be resolved through negotiation or mediation under Nigerian law. If unresolved, disputes may be referred to arbitration as stated in the Terms & Conditions.
